Remote Buying Terms & Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. ONCE YOU AGREE TO THESE TERMS AND CONDITIONS YOUR AGREEMENT IS NON-REVOCABLE AND YOU CANNOT CHANGE THESE TERMS AND CONDITIONS. THESE TERMS AS CONDITIONS ARE SUBJECT TO CHANGE AT ANY TIME WITHOUT NOTICE AS THE REMOTE BUYING PROCESS EVOLVES.

For a more streamlined process to send your items to us, please also prepare the shipment weight and package dimensions that you will be sending in. We will also need your full shipping address to issue the label. We need this information from you to issue a label for shipping.

LUKES IN ITS SOLE DISCRETION WILL QUOTE AN estimate of what IT WILL PAY FOR YOUR ITEMS AND THIS IS SUBJECT TO CHANGE IN LUKES SOLE DISCRETION UPON PHYSICAL INSPECTION of your items upon receipt. The price we pay for your items could be lower or higher than our estimate depending on any number of factors. We expressly reserve the right to change our offered payment at any time and you consent to the same. If the offered price range works for you, we will issue you a shipping label to our Los Angeles Store. Once we receive the item(s) we will thoroughly inspect it, authenticate it, look over it and tell you a price we can pay for it.  We issue payments via PayPal or Venmo (we do not cover TRANSACTION fees) or via bank ACH (ACH TAKES LONGER; WE DON'T CONTROL THAT TIMING). If we decide to pass on YOUR item(s) or you decide not to take our offer you will pay for return shipping; no exceptions. Please note; we reserve the right to pass on any item(s) IN LUKES/our SOLE DISCRETION for any reason WHATSOEVER. Also note that LUKES will not be liable for any items that are lost in transit during shipping to and from our store.  at all times you bear your own risk of loss without any liability to LUKES. If any shipments are lost, please contact the carrier to escalate your claims for lost packages. FOR THE AVOIDANCE OF DOUBT PLEASE NOTE THAT YOU ARE LEGALLY BOUND BY THE foregoing and the FOLLOWING AND never shall HAVE any CLAIMS OF DAMAGES AGAINST LUKES FOR ANY REASON PERTAINING TO BUYING TRANSACTIONS WITH US. OUR PRICING AND OFFERS WILL VARY and may  be subject to change. LUKES DECIDES WHAT WE PAY IN OUR SOLE AND INDEPENDENT DISCRETION.  OFFERS ARE NOT NEGOTIABLE. LUKES HAS THE SOLE DISCRETION TO PASS ON ANY OR ALL OF YOUR ITEMS AND SEND THEM BACK TO YOU AT YOUR EXPENSE. YOU ARE RESPONSIBLE FOR YOUR OWN RETURN SHIPPING. ANY ITEMS NOT SHIPPED BACK OR DUMPED ON US, THAT WE DO NOT SELECT FOR PURCHASE WILL BE DONATED IF YOU FAIL TO PAY FOR SHIPPING AND YOU AGREE TO THAT BY CONSENTING TO THESE TERMS AND CONDITIONS. LUKES IS NOT LIABLE TO YOU FOR ANYTHING ASSOCIATED WITH THE REMOTE BUYING PROCESS. YOU EXPRESSLY AGREE THAT ANYTHING ASSOCIATED WITH THE REMOTE BUYING PROCESS AND ANY RESULTANT COMPLICATIONS ARE YOUR OWN SOLE RESPONSIBILITY AND LUKES SHALL HAVE NO RESPONSIBILITY WHATSOEVER FOR YOU FOR ANY ISSUES ASSOCIATED WITH THE REMOTE BUYING PROCESS as you waive any contract or obligations on the part of LUKES. ONCE YOUR ITEMS ARE BOUGHT AND PAID FOR BY LUKES, WE SHALL HAVE NO FURTHER OBLIGATION TO YOU WHATSOEVER. THEREFORE, BY ENGAGING IN THE REMOTE PROCESS, WIN OR LOSE, YOU HEREBY EXPRESSLY HOLD LUKES AND ITS AFFILIATED COMPANY HARMLESS FROM ANY AND ALL CLAIMS CONNECTED THEREWITH AND WHATSOEVER and understand that no contract is created at law which shall put LUKES under any obligation at any time during the buying process. Simply put, LUKES never has any obligation to buy, sell, take or be responsibility for your products. You are the sole responsible party at all times for your items, if you want to them sell to us; that is only the bargained for exchange here.  you further agree and understand that no other contracts exist between you or LUKES at law and/or in equity.
